New section 17

The principal Act is amended by inserting, immediately after section 16, the following section:“Administrative exemption from section 1617.—

(1)

The Postal Authority may, where the Postal Authority is satisfied that all of the matters in subsection (2) apply, exempt —

(a)

a particular developer of a particular residential building or a particular commercial or industrial building from the application of section 16(3)(a); or

(b)

a particular applicable person for a particular residential building or a particular commercial or industrial building from the application of section 16(4A)(a) or (b).(2) The matters mentioned in subsection (1) are the following:

(a)

that either of the following applies:

(i)

there is no suitable location in the particular residential building or the particular commercial or industrial building for letter boxes to be provided;

(ii)

having regard to the use or intended use of the particular residential building or the particular commercial or industrial building, there is no need for letter boxes to be provided;

(b)

appropriate alternative arrangements have been or will be made by the particular developer or particular applicable person for the receipt of postal articles.(3) An exemption under this section —

(a)

must be in writing and given to the particular developer or particular applicable person, as the case may be; and

(b)

need not be published in the Gazette.(4) In this section, “applicable person” has the meaning given by section 16(9).”.
