4. Condition of exemption

The exemption in paragraph 3 is subject to the condition that the event organiser must implement all of the following measures to facilitate the collection of any beverage container that is used for any beverage product supplied by any person mentioned in that paragraph to another person (A) in the circumstances mentioned in that paragraph:

the event organiser must —

if the event organiser supplies the beverage product to A — communicate to A, at the specified event venue, all of the following information (collectively called in this paragraph specified information):

no deposit is being collected from A in respect of the beverage product; (B)A must return such beverage container to the event organiser by a measure mentioned in sub‑paragraph (b) or (c); and

if any person mentioned in paragraph 3(b) supplies the beverage product to A —

communicate to A, at the specified event venue, all the specified information; and (B)ensure that the person supplying the beverage product to A communicates to A, at the specified event venue, all the specified information;

the event organiser must retrieve such beverage container or ensure such beverage container is retrieved from A (including after it is left behind by A) in the specified event venue;

the event organiser must provide or ensure the provision of a means (including a place or facility, whether shared or otherwise) in the specified event venue for A to return such beverage container to the event organiser.
