Protection of hospital patients

(1)
A person who is at a hospital as a patient must not be required to provide a specimen for a breath test or to provide a specimen for a laboratory test unless the registered medical practitioner in immediate charge of his or her case authorises it and the specimen is to be provided at the hospital.
(2)
The registered medical practitioner mentioned in subsection (1) must not authorise a specimen to be taken where it would be prejudicial to the proper care and treatment of the patient.
