71. Protection of hospital patients
Feedback & supportA person who is at a hospital as a patient must not be required to provide a specimen for a breath test or to provide a specimen for a laboratory test unless the registered medical practitioner in immediate charge of his or her case authorises it and the specimen is to be provided at the hospital.

“breath test” means a test of a specimen of a person’s breath to assess —(a)whether there is alcohol present in the person’s breath; and(b)if alcohol is present, the concentration of alcohol in the person’s breath,by means of a breath analysing device of a type approved by the Deputy Commissioner of Police;
The registered medical practitioner mentioned in subsection (1) must not authorise a specimen to be taken where it would be prejudicial to the proper care and treatment of the patient.
