Clause 1

Short title and commencement

This Ordinance may be cited as the Rubber Estates Assessment (Amendment) Ordinance, 1963, and, with the exception of paragraph (a) of section 2 and paragraph (a) of section 3 of this Ordinance, shall come into operation on such date as the Minister may by notification in the Gazette appoint.(2) Paragraph (a) of section 2 and paragraph (a) of section 3 of this Ordinance shall be deemed to have come into operation on the 1st day of January 1961.

This Ordinance may be cited as the Rubber Estates Assessment (Amendment) Ordinance, 1963, and, with the exception of paragraph (a) of section 2 and paragraph (a) of section 3 of this Ordinance, shall come into operation on such date as the Minister may by notification in the Gazette appoint.

Amendment of section 3

Section 3 of the Rubber Estates Assessment Ordinance (hereinafter in this Ordinance referred to as the “principal Ordinance”) is hereby amended —

(a)

by deleting the proviso to subsection (1) thereof and substituting therefor the following: —“Provided that in respect of any such rubber estate or part thereof in which during any quarter no rubber trees are tapped or in which the rubber trees are not tapped to the satisfaction of the Comptroller, the owner thereof shall pay to the Comptroller a rate of eight dollars and seventy-five cents per acre or part of an acre in respect of such quarter, in lieu of the rate payable under this section.”; and

(b)

by deleting the word “Minister” appearing in the second line of subsection (3) thereof and substituting therefor the word “Comptroller”.

Section 4 of the principal Ordinance is hereby amended —

(a)

by deleting the proviso to subsection (1) thereof and substituting therefor the following: —“Provided that in respect of any such rubber estate or part thereof in which during any quarter no rubber trees are tapped or in which the rubber trees are not tapped to the satisfaction of the Comptroller, the owner thereof shall pay to the Comptroller a rate of eight dollars and seventy-five cents per acre or part of an acre in respect of such quarter, in lieu of the rate payable under this section.”; and

(b)

by inserting immediately after the words “shall be” appearing in the first line of subsection (2) thereof the words “fixed by the Minister and shall be”.

Subsection (1) of section 5 of the principal Ordinance is hereby amended by deleting the word “its” appearing in the first line and in the second line thereof and substituting therefor the word “his”.

Subsection (3) of section 7 of the principal Ordinance is hereby amended —

(a)

by deleting the word “it” appearing in the second line thereof and substituting therefor the word “he”; and

(b)

by deleting the word “its” appearing in the fourth line thereof and substituting therefor the word “his”.
