Utility or apparatus to be properly maintained
Subregulation 1
It shall be the duty of the owner of any utility or apparatus situated on or along, or beneath the surface of, any public street to ensure that the utility or apparatus —
is properly maintained and kept in a working condition at all times;
does not in any way alter or affect the structure of the public street or any road related facility; and
does not cause or become a cause of danger or inconvenience to persons using the public street.
Subregulation 2
If any of the requirements referred to in paragraph (1) is not complied with, the Authority may take such steps as it thinks necessary to ensure that such requirement is met and recover any costs incurred by it from the owner of the utility or apparatus.
