Regulation 26

Liability to indemnify Authority against injury claims, etc.

The owner of any utility or apparatus situated on or along, or beneath the surface of, any public street shall indemnify the Authority against any claim in respect of any injury, damage or loss suffered by any other person as a result of —

(a)

the situation or presence of the utility or apparatus; or

(b)

the carrying out of any works on the public street for, or authorised by, the owner of the utility or apparatus.
