Non-abatement of application under section 71 by reason of vacation of office of President

An application under section 71 shall not be abated by reason only of the vacation of office of President by the defendant, and in the event of such vacation of office, the application under section 71 shall be heard or continued to be heard and determined as though such office had not been vacated.
