Regulation 11

Offences and penalties

Subregulation 1

Any person who —

(a)

contravenes any of the provisions of regulation 4, 5, 6, 8 or 9;

(b)

contravenes any condition imposed under regulation 12;

(c)

obstructs or hinders an officer of the Authority in the exercise of his powers under these Regulations;

(d)

fails to comply with a notice of an officer of the Authority referred to in regulation 10(c); or

(e)

being required by such a notice to provide information to an officer of the Authority, provides any information which he knows or has reason to believe is false in a material particular,shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $20,000 or to imprisonment for a term not exceeding 2 years or to both.

Subregulation 2

In proceedings brought against —

(a)

the operator of an oil handling facility for the contravention of regulation 4(1) or 5(1); or

(b)

the owner of a tug boat for the contravention of regulation 4(3) or 5(2),it shall be a defence for the person charged to show that he has taken all reasonable steps to replenish or replace the stocks of dispersants referred to in regulation 4 or equipment referred to in regulation 5(1) or (2), as the case may be, within a reasonable time.
