Regulation 23

The Minister must, subject to paragraph (2), determine and apply an individual countervailing duty rate for each known exporter or producer concerned of the subject goods that has been individually investigated.

Where limited examination is carried out under regulation 33, the Minister must apply to any exporter or producer not included in the investigation a rate that is equal to the weighted average of the individual countervailing duty rates established for all exporters and producers individually examined, provided that the Minister must disregard any rate determined under the circumstances referred to in section 37 of the Act.
