Extension review

Subregulation 1

The Minister must publish a notice of any impending termination of the imposition of countervailing or anti‑dumping duties at least 6 months prior to the end of the 5-year period referred to in section 12(7) or 26(7) of the Act, as the case may be.

Subregulation 2

The Minister must specify in the notice the period within which any interested parties may present their views on such termination of imposition of duties.

Subregulation 3

Where an interested party provides evidence or the Minister otherwise obtains information that the termination of the imposition of duties would be likely to lead to continuation or recurrence of countervailable subsidisation or dumping (as the case may be) and injury, the Minister must publish a notice of initiation of a review under section 12(7) or 26(7) of the Act to examine whether to extend the imposition of duties.

Subregulation 4

An extension review referred to in paragraph (3) must normally be completed within 180 days from the date of publication of the notice of initiation of the review but it must not in any case extend beyond one year after that date.

Subregulation 5

The imposition of countervailing or anti-dumping duties is to continue pending the outcome of the extension review.

Subregulation 6

Except for paragraph (5), this regulation applies, with the necessary modifications, to the review of undertakings under section 12(1)(d) or 26(1)(d) of the Act.
