Regulation 22

Time period for submission of request for participation and tender

Subregulation 1

Subject to paragraphs (2) and (6), where selective tendering is used, the time period for submission of a request for participation must not be less than 25 days from the date of publication of the notice of intended procurement in an approved medium.

Subregulation 2

Where a state of urgency duly substantiated by the contracting authority renders the time period specified in paragraph (1) impracticable, the time period may be reduced to not less than 10 days.

Subregulation 3

Subject to paragraphs (4) to (9), the time period for submission of a tender must not be less than 40 days from the date on which —

(a)

in the case of open tendering — the notice of intended procurement is published in an approved medium; or

(b)

in the case of selective tendering — the suppliers are notified that they will be invited to submit tenders, whether or not a multi‑use list is used.

Subregulation 4

A contracting authority may reduce the time period for tendering established in accordance with paragraph (3) to not less than 10 days in the case where —

(a)

the contracting authority has published a notice of planned procurement mentioned in regulation 12(1) at least 40 days but not more than 12 months before the publication of the notice of intended procurement, and the notice of planned procurement contains —

(i)

a description of the procurement;

(ii)

the approximate final dates for the submission of tenders or requests for participation;

(iii)

a statement that interested suppliers should express their interest in the procurement to the contracting authority;

(iv)

the address from which documents relating to the procurement may be obtained; and

(v)

as much of the information that is required for the notice of intended procurement under regulation 10(2), as is available;

(b)

in the case of recurring contracts, the contracting authority indicates in the initial notice of intended procurement that subsequent notices of intended procurement will provide time periods for tendering based on this paragraph; or

(c)

a state of urgency, duly substantiated by the contracting authority, renders the time period for tendering established in accordance with paragraph (3) impracticable.

Subregulation 5

A contracting authority may reduce the time period for tendering established in accordance with paragraph (3) by 5 days for each of the following circumstances:

(a)

the notice of intended procurement is published by electronic means;

(b)

all the tender documentation are made available by electronic means from the date of the publication of the notice of intended procurement;

(c)

the contracting authority accepts tenders by electronic means.

Subregulation 6

In the case where paragraphs (4) and (5) apply in respect of an open tendering or a selective tendering (as the case may be) the time period established in accordance with paragraph (3) must not be less than 10 days from the date on which the notice of intended procurement is published.

Subregulation 7

Despite any other provision in this regulation, where a contracting authority purchases commercial goods or services, or any combination thereof, the contracting authority may reduce the time period for tendering established in accordance with paragraph (3) —

(a)

to not less than 13 days if the contracting authority publishes by electronic means, at the same time, both the notice of intended procurement and the tender documentation; or

(b)

to not less than 10 days if the contracting authority accepts tenders for commercial goods or services by electronic means.

Subregulation 8

Where the contracting authority is a contracting authority listed in Part 2 of the Second Schedule to the Order, the time period may be fixed by the mutual agreement between the contracting authority and the suppliers.

Subregulation 9

The contracting authority referred to in paragraph (8) may, in the absence of an agreement referred to in that paragraph, fix a time period of not less than 10 days.
