Selective tendering
Subregulation 1
Where a contracting authority uses selective tendering, the contracting authority must —
include in the notice of intended procurement at least the information required in regulation 10(2)(a), (b), (f), (g), (j), (k) and (l) and invite suppliers to submit a request for participation; and
on or before the date of commencement of the time period for submission of the tender under regulation 22, provide the information required under regulation 10(2)(c), (d), (e), (h) and (i) to the qualified suppliers notified under regulation 22(3)(b).
Subregulation 2
A contracting authority must allow all qualified suppliers to participate in a particular procurement, unless the contracting authority states in the notice of intended procurement of any limitation as to the number of suppliers that will be permitted to tender and the criteria for selecting the limited number of suppliers.
Subregulation 3
Where the tender documentation is not made publicly available from the date of publication of the notice referred to in paragraph (1), the contracting authority must ensure that those documents are made available at the same time to all the qualified suppliers referred to in or selected in accordance with paragraph (2).
