Citation and commencement
This Notification may be cited as the Planning (Covered Pedestrian Linkways Authorisation) Notification 2014 and shall come into operation on 1 December 2014.

Citation and commencement
This Notification may be cited as the Planning (Covered Pedestrian Linkways Authorisation) Notification 2014 and shall come into operation on 1 December 2014.
Definitions
In this Notification, unless the context otherwise requires —“covered pedestrian linkway” means a walkway on the ground which —
is covered on the top;
is open on all sides;
is connected to or facilitates pedestrian access to any public transport facility, public facility or building; and
is not part of any building;“Town Council” means a Town Council established under section 4 of the Town Councils Act (Cap. 329A).

Authorisation for covered pedestrian linkways
Subject to paragraphs 4 and 5 and any other written law, the following operations involving the development of land, carried out by any statutory authority, are authorised under section 21(6) of the Act:
the construction of a covered pedestrian linkway which is not within the boundaries of a street;
the carrying out of works for the maintenance or improvement of a covered pedestrian linkway which is not within the boundaries of a street.
Subject to paragraphs 4 and 5 and any other written law, the following operations involving the development of land, carried out by any Town Council, are authorised under section 21(6) of the Act:
the construction of a covered pedestrian linkway;
the carrying out of works for the maintenance or improvement of a covered pedestrian linkway.
Conditions of authorisation for covered pedestrian linkways
The authorisation for carrying out an operation involving the development of land under paragraph 3 shall apply subject to the following conditions:
the written consent of the owner of the land for the carrying out of the operation is obtained prior to the carrying out of the operation;
any approval from any relevant authority required for the carrying out of the operation is obtained prior to the carrying out of the operation;
no part of the operation comprises works that are not authorised under the Act.
Authorisation to cease to apply
The authorisation for carrying out an operation involving the development of land under paragraph 3 shall immediately cease to apply if —
any consent or approval referred to in paragraph 4(a) or (b) lapses, is revoked or, for any other reason, is no longer valid or applicable; or
any other condition of authorisation referred to in paragraph 4 ceases to be complied with.
