Regulation 17
Permission to store and use hazardous substances
Subregulation 1
A person shall not use, keep or have in his possession or under his control any hazardous substance specified in the Schedule unless he is authorised to store such hazardous substance.
Subregulation 2
A person is authorised to store any hazardous substance if —
the person is issued with a permit to store and use the hazardous substance;
the person is in possession of a licence granted under section 22 of the Act to deal in the hazardous substance; or
the hazardous substance falls within any exclusion specified in the second column of Part I of the Second Schedule to the Act corresponding to that substance or is contained in any substance, preparation or product specified in Part II of that Schedule.
Subregulation 3
A permit to store and use hazardous substances is valid for a period of 5 years starting from the date specified in the permit.
Subregulation 4
The following fees shall be payable to the Agency in respect of a permit to store and use hazardous substances:
a fee of $450 for a permit issued or renewed for a period of 5 years;
a fee of $180 for making amendments to the permit on any one occasion.
Subregulation 5
It shall not be lawful for any person to store or use any hazardous substance specified in the Schedule unless the storage or use of the hazardous substance is effected in accordance with the provisions of the permit and with any condition specified therein.
