Offences
Subregulation 1
Any person who contravenes regulation 4(4), 5(1), (2) or (3), 6(1) or (2), 7, 10(1)(e) or 11(4A) or (4B) shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $5,000 and, in the case of a continuing offence, to a further fine not exceeding $500 for every day or part thereof during which the offence continues after conviction.
Subregulation 2
Any person who contravenes regulation 8(1), 9(1), 9A(1), 10(1)(a), (b), (c) or (d) or (3) or 11(2) shall be guilty of an offence and shall be liable —
on the first conviction for the offence, to a fine not exceeding $15,000 or to imprisonment for a term not exceeding 3 months or to both and, in the case of a continuing offence, to a further fine not exceeding $500 for every day or part of a day during which the offence continues after conviction; and
on a second or subsequent conviction for the same offence, to a fine not exceeding $30,000 or to imprisonment for a term not exceeding 3 months or to both and, in the case of a continuing offence, to a further fine not exceeding $1,000 for every day or part of a day during which the offence continues after conviction.
