Regulation 10

Cancellation, suspension, etc., of licence

In addition to any penalty which may be imposed under these Regulations or otherwise, if a licensee —

(a)

has, in the opinion of the Authority, obtained his licence by making or causing to be made or produced any false or fraudulent declaration, certificate, or representation, in writing or otherwise;

(b)

has been convicted of any offence under the Act or any regulations made thereunder, or of any other offence which is of such a nature as to render it, in the opinion of the Authority, undesirable that he should continue to hold such licence;

(c)

contravenes any term or condition of his licence;

(d)

having been given notice under regulation 9 to attend at a specified time and place to take a test or an examination as required by the Authority, fails to attend at that time or place or fails the test or examination;

(e)

is, in the opinion of the Authority, for any reason incapable of carrying out the cable detection work in respect of which the licence was granted;

(f)

applies to have his licence cancelled or suspended; or

(g)

is, in the opinion of the Authority, for any other reason, unfit to hold or to continue to hold a licence,the Authority may cancel or suspend the licence for such period as the Authority thinks fit.

Subregulation 2

Where a licence is cancelled or suspended, no fee or part thereof shall be refunded by the Authority to the licensee in respect of the unexpired period of the licence.

Where the Authority is satisfied in any case that a licensee has failed to comply with the condition referred to in regulation 8(2), the Authority may, without prejudice to any other action that it is entitled to take under the Act or these Regulations, order the licensee to undergo such retraining as the Authority may specify for a period not exceeding 12 months.
