Minister to consider whether appeal to be determined by Appeal Panel
Subregulation 1
Without affecting regulation 15 or 23, the Minister must consider whether an appeal made to the Minister ought to be considered and determined by an Appeal Panel under section 98(2) of the Act —
upon receiving the Notice of Appeal for the appeal; or
where regulation 7 applies, upon the appellant complying with the directions given by the Minister to remedy the defective Notice of Appeal.
Subregulation 2
Where the Minister considers that the appeal need not be considered and determined by an Appeal Panel, the Minister must instruct the Appeals Secretary to send a copy of the Notice of Appeal to the Authority.
Subregulation 3
Where the Minister considers that the appeal ought to be considered and determined by an Appeal Panel, the Minister must —
instruct the Appeals Secretary to notify the appellant accordingly; and
establish an Appeal Panel under section 65 of the Act to consider and determine the appeal,and nothing further in these Regulations applies to the appeal.
