Regulation 45A

Late payment of specified charges

Subregulation 1

A reminder fee specified in the Third Schedule is payable to the Board or the agent of the Board on every reminder issued by the Board or the agent of the Board to a person who has failed to make payment in accordance with a bill sent to the person relating to any specified charge.

Subregulation 2

Where —

(a)

a reminder mentioned in paragraph (1) has been issued by the Board or the agent of the Board to a person to make payment in accordance with a bill sent to the person relating to any specified charge; and

(b)

any amount stated in that bill for any specified charge remains unpaid by the person upon the issue of the next bill to the person,then a late payment charge of 1% of the amount remaining unpaid is payable by the person.

In this regulation, “specified charge” means any of the following:

(a)

the price mentioned in regulation 3(1) of the Public Utilities (Tariffs for Water) Regulations (Rg 7) for water (including any amount mentioned in regulation 3(2) of those Regulations equivalent to the goods and services tax chargeable on the supply of the water and payable as part of the price) payable by the person to the Board;

(b)

any waterborne tax under section 20 of the Act payable by the person to the Board;

(c)

any water conservation tax under section 20A of the Act payable by the person to the Board;

(d)

where the Board has discontinued the supply of water to any premises under section 23(1) of the Act, the fee mentioned in regulation 36(15) for resuming the supply of water to those premises;

(e)

any late payment charge imposed under paragraph (2) on the person.
