Regulation 109

Summoning of meetings

Subregulation 1

The liquidator shall summon all meetings of creditors and partners by giving not less than 7 days’ notice of the time and place thereof in the Gazette and in one local newspaper; and shall not less than 7 days before the day appointed for the meeting send by post to every person appearing, by the LLP’s books, to be a creditor of the LLP, notice of the meeting of creditors, and to every person appearing, by the LLP’s books, or otherwise, to be a partner of the LLP, notice of the meeting of partners.

Subregulation 2

The notice to each creditor shall be sent to the address given in his proof, or, if he has not proved, to the address given in the statement of affairs of the LLP, or to such other address as may be known to the person summoning the meeting.

Subregulation 3

The notice to each partner shall be sent to the address mentioned in the LLP’s books as the address of such partner, or to such other address as may be known to the person summoning the meeting.

Subregulation 4

This rule shall not apply to meetings under paragraph 43 or 55 of the Fifth Schedule to the Act.
