49. Application for examination under paragraph 31 of Fifth Schedule to Act

An application to the Court to summon persons for examination under paragraph 31 of the Fifth Schedule to the Act shall be made without notice and may be made by the liquidator or any creditor or partner. If made by a creditor or partner the summons and affidavit in support thereof shall be served on the liquidator.
