Notice to creditors to prove

Subject to the provisions of the Act, and unless otherwise ordered by the Court, the liquidator in any winding up may from time to time fix a day (which shall not be less than 14 days from the date of the notice) on or before which the creditors of the LLP are to prove their debts or claims, or be excluded from the benefit of any distribution made before the debts are proved, and the liquidator shall give notice of the day so fixed by advertisement in the Gazette in Form 57(3) and in such newspaper as he shall think convenient, and also notice in writing of such day in Form 39 or 40 to every person who, to the knowledge of the liquidator, claims to be a creditor of the LLP and whose claim has not been admitted or, in a winding up by the Court, to every person mentioned in the statement of affairs as a creditor who has not proved his debt.
