Regulations 6(1) and 7, and in the case of a therapeutic product only, regulation 8, do not apply to a reference advertisement or a trade advertisement.

In this regulation —

Definition

“reference advertisement” means a form of advertisement of a specified health product —

(a)

containing a brief description of the specified health product, its intended purpose, and any contraindications or warnings relating to its use; and

(b)

appearing in a publication consisting mainly of such forms of advertisement where the publication is published by a person, who is not the manufacturer, supplier, retailer, importer or exporter of the specified health product, to one or more of the classes of relevant health professionals;

Definition

“trade advertisement” means a form of advertisement of a specified health product which —

(a)

is published by means of a catalogue, price list or other document for the purpose of supplying the specified health product by wholesale; and

(b)

does not contain any recommendation relating to the use of the specified health product, other than as part of the name of the specified health product or as part of any heading or subheading indicating a therapeutic classification.
