For the purposes of section 66(2)(d) of the Act, the Authority may disclose any confidential information relating to the quality, safety or efficacy of a medical device, if —
(a)
the disclosure is, in the opinion of the Authority, necessary to protect the health or safety of members of the public; or
(b)
the disclosure is to a Government department or statutory body in order to enable the Government department or statutory body to perform its public functions.
