Objectives (P. 1, r. 4)
Subregulation 1
These Rules are to be given a purposive interpretation.
Subregulation 2
These Rules seek to enable the Court to achieve the following Objectives:
fair access to justice;
expeditious proceedings;
cost-effective resolution of cases in a manner proportionate to —
the nature, complexity and importance of the issues; and
if applicable, the value of the claims,in the case before the Court;
where a child is a party to or a subject of the proceedings, placing the child’s welfare as the paramount consideration;
fair and practical results for parties;
efficient use of court resources.
Subregulation 3
The Court must seek to give effect to the Objectives in interpreting these Rules, exercising any power under these Rules and in all its orders or directions.
Subregulation 4
All parties have the duty to assist the Court and to conduct their cases in a manner which will help to achieve the Objectives.
