Regulation 14

Applications under section 121B of Act (P. 2, r. 14)

Subregulation 1

Despite any other provision of these Rules, a person who makes an application under section 121B of the Act must file an originating application in Form 14 supported by all documents specified in that Form or any practice directions relating to that application.

Subregulation 2

The applicant must serve on the respondent all of the following documents:

(a)

the originating application mentioned in paragraph (1);

(b)

in relation to the applicant’s application under section 121D of the Act for the permission of the Court —

(i)

the originating application without notice and supporting affidavit mentioned in Rule 13; and

(ii)

the order of the Court granting permission.

Subregulation 3

Where the respondent wishes to make a counterclaim to the applicant’s claim for ancillary relief, the respondent is not required to file a cross‑application.
