Regulation 142

Proceedings for inquiry into VCC’s or sub‑fund’s dealings, etc.

Subregulation 1

The Court may either in the order made under section 244(1) of the IRDA or by a subsequent order give directions as to the matters on which any person is to be examined under section 244(4) of the IRDA.

Subregulation 2

An examination under section 244(4) of the IRDA is to be held in chambers, or before a District Judge (if so directed by the Court under section 244(5)(a) of the IRDA).

Subregulation 3

Unless the Court has directed under section 244(5)(b) of the IRDA that the examination be held in public, the Court may order that the examination not be held in open court and not be open to the public.

Subregulation 4

Where on an examination of any person held before a District Judge pursuant to section 244(5)(a) of the IRDA, the District Judge considers the examination is unnecessarily protracted, or for any other sufficient cause, the District Judge may adjourn the examination so that the examination may be held before the Court.
