Regulation 146

Application for longer period to give notice of disclaimer

Subregulation 1

An application to the Court by a liquidator for a longer period to give a notice of disclaimer of onerous property (otherwise required under section 230(4)(b)(ii) of the IRDA to be given within the period stated in that provision) must be made by the liquidator in accordance with this rule.

Subregulation 2

The affidavit supporting the application mentioned in paragraph (1) must state the reasons for the application.

Subregulation 3

A copy each of the application mentioned in paragraph (1) and the affidavit supporting the application must be served on every person interested in the property in question who has applied in writing to the liquidator or any of the liquidator’s predecessors as liquidator in accordance with section 230(4)(b)(i) of the IRDA.
