38B. Executive workplace safety and health course

Subject to paragraphs (2) and (3) (as applicable), every regulated person must ensure that, at all times, at least one specified officer of the regulated person has successfully completed a relevant course.
Where the only or last remaining specified officer of a regulated person who has successfully completed a relevant course ceases to be a specified officer of the regulated person, the regulated person must ensure compliance with paragraph (1) within 3 months after the date of that cessation.
If a person commences a business in a high-risk industry on or after 1 March 2024, that person must ensure compliance with paragraph (1) within 3 months after the date of commencing the business.
A regulated person that contravenes paragraph (1) shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $20,000 and, in the case of a continuing offence, to a further fine not exceeding $1,000 for every day or part of a day during which the offence continues after conviction.
