How to affix and display identification mark

For the purposes of section 28G(1)(b) of the Act, the registered responsible person for a March 2020 registered registrable PMD must ensure that any identification mark for that PMD is affixed and displayed on the PMD —

(a)

as follows, whichever is practicable:

(i)

permanently affixed on the front portion of the immovable part of the stem of the PMD, near its front wheel;

(ii)

permanently affixed on either side of the immovable part of the stem of the PMD, near its front wheel; (iii)permanently affixed at such other part of the PMD as the Authority may allow in any particular case; and

(b)

so that the identification mark —

(i)

is not obscured;

(ii)

is visible from the front or side of the PMD when it is in motion;

(iii)

is not upside down; and

(iv)

is displayed in compliance with the Schedule.

For the purposes of section 28G(1)(b) of the Act, the registered responsible person for an April 2020 registered registrable PMD must ensure that any identification mark for that PMD is affixed and displayed on the PMD —

(a)

as follows, whichever is practicable:

(i)

permanently affixed on any part of the front or back portion of the PMD;

(ii)

permanently affixed to an accessory that is permanently attached to the front or back of the PMD;

(iii)

permanently affixed at such other part of the PMD as the Authority may allow in any particular case; and

(b)

so that the identification mark —

(i)

is not obscured;

(ii)

is visible from the front or back of the PMD whether the PMD is stationary or in motion;

(iii)

is not upside down; and

(iv)

is displayed in compliance with the Schedule.

In this regulation —

Definition

“March 2020 registered registrable PMD” means a registered registrable PMD —

(a)

the registration of which was granted before 3 April 2020; and

(b)

that, on 3 April 2020, has affixed and displayed on it, in compliance with paragraph (1), the identification mark for the PMD; and

Definition

“April 2020 registered registrable PMD” means a registered registrable PMD —

(a)

the registration of which is granted on or after 3 April 2020; or

(b)

the registration of which was granted before 3 April 2020 and that on that date, does not have affixed and displayed on it, in compliance with paragraph (1), the identification mark for the PMD.
