18. Appeal under section 17 by surviving applicant

Where an ASA was issued to joint applicants of whom one subsequently dies —
ASA
“Adoption Suitability Assessment” or “ASA” means an Adoption Suitability Assessment issued by an authorised adoption agency under section 14;
an appeal under section 17 may be made by the surviving applicant; and
applicant
“applicant” means an individual who makes an adoption application, whether solely or jointly, and for the purposes of Part 2, includes an individual who intends to make an adoption application; and
the power under section 17(6)(b) to vary an ASA includes the power to vary an ASA from one issued jointly to the applicants to one issued solely to the surviving applicant.
