Appeal to Minister
of Building and Construction Authority Act 1999
(1)
Any person whose application for a licence, an import permit or a storage permit, or for the renewal of a licence, has been refused by the Authority may, within 14 days after being notified of such refusal, appeal in the prescribed manner to the Minister, whose decision is final.
(2)
Where a licence, an import permit or a storage permit granted by the Authority is subject to conditions, the licensee or holder of the permit concerned may, within 14 days after being notified of such conditions, appeal in the prescribed manner to the Minister, whose decision is final.
(3)
If the Authority has made any order —
under section 40 in respect of a licence or licensee; or
cancelling any import permit or storage permit under section 41(1) or (3),the person against whom such an order is made may, within 14 days after being served with the notice of the order, appeal to the Minister against the order, and the decision of the Minister is final.
(4)
In any appeal under this section in relation to the conviction of a licensee for a criminal offence, the Minister on appeal from any order of the Authority is to accept the licensee’s conviction as final and conclusive.[31P
