Lapsing or revocation of building plans approval
(1)
Any approval granted under section 5 or 5A in respect of any building works automatically lapses —
when any written permission mentioned in section 12 of the Planning Act 1998 that has been granted in respect of any development of land involving the building works lapses pursuant to section 20 of that Act;
if no such written permission has been granted in respect of those building works, at the end of a continuous period of 6 months during which the building works are suspended; or
if the building works do not start within the period prescribed in the building regulations.
(2)
The Commissioner of Building Control may, at any time, revoke any approval granted in respect of any building works under section 5 or 5A if he or she is satisfied that any information given in the application for approval or any document submitted to the Commissioner of Building Control in connection with the application for approval is false in a material particular.
(3)
Where the Commissioner of Building Control has under subsection (2) revoked any approval granted under section 5 or 5A in respect of any plans of building works, any permit, certificate of statutory completion and temporary occupation permit granted in respect of those building works also automatically lapses.
