Regulation 34A

Where the building works result in the formation of a new slope or embankment, the qualified person appointed under section 8(1)(a) or 11(1)(d)(i) of the Act shall determine and ascertain the integrity and stability of the new slope or embankment; and where appropriate, provide or cause to be provided a retaining wall or other earth retaining structure, or protective measures to stabilise the new slope or embankment.
