Part 4 · Family Exclusion Orders and Family Visit Limits

40. Adjournment of oral hearings relating to family exclusion orders or family visit limits

(1)

A Committee of Assessors or a review committee may, from time to time, without requiring the attendance of any party, adjourn an oral hearing relating to a family exclusion order or family visit limit to a later date if that Committee or review committee is satisfied that the notice to the family respondent to attend the hearing has not been served or that there is some other adequate reason for the adjournment.

(2)

The date fixed for an adjourned hearing relating to a family exclusion order or family visit limit must be within 28 days after the date on which the adjournment is ordered unless the Committee of Assessors or review committee which ordered the adjournment is satisfied that —

(a)

a later date is required to enable the notice to be served; or

(b)

there is some other adequate reason for fixing a later date.

(3)

If an oral hearing relating to a family exclusion order or family visit limit is adjourned, the Committee of Assessors or the review committee at the adjourned oral hearing need not comprise the same members as the Committee or the review committee (as the case may be) which ordered the adjournment.
