Prescribed circumstances for disclosure, etc., of central registers of nominee directors and nominee shareholders

Subregulation 1

For the purposes of section 386ANA(6) of the Act, the Registrar may disclose any information in the central register of nominee directors or the central register of nominee shareholders kept by the Registrar to a public agency, where —

(a)

the public agency has requested information in the central register of nominee directors or the central register of nominee shareholders; and

(b)

the information so requested has been requested for the purpose of enabling the public agency to administer or enforce any written law.

Subregulation 2

For the purpose of section 386ANA(6) of the Act, the Registrar may disclose information regarding any nominee director or nominee shareholder of a company or foreign company as reflected in the central register of nominee directors or the central register of nominee shareholders, to any member of the public —

(a)

as part of a service provided to the public by the Accounting and Corporate Regulatory Authority by which information relating to transactions with the Registrar is supplied to the public, using the electronic transaction system;

(b)

as part of the implementation of Part 6A of the Accounting and Corporate Regulatory Authority Act 2004, using the electronic transaction system; or

(c)

for any other reason.

In this regulation —

Definition

“electronic transaction system” means the electronic transaction system established by the Accounting and Corporate Regulatory Authority under section 27(1) of the Accounting and Corporate Regulatory Authority Act 2004;

Definition

“public agency” has the meaning given by section 386AM(6) of the Act.
