Section 121
Nature of copyright in sound recordings
For the purposes of this Act, unless the contrary intention appears, copyright in a sound recording is —
(a)
the exclusive right to do all or any of the following acts:
(i)
to make a copy of the recording;
(ii)
to enter into a commercial rental arrangement in respect of the recording;
(iii)
to publish the recording if it is unpublished;
(iv)
to communicate the recording to the public; and
(b)
if the recording has been published for commercial purposes and a person (X) causes the sounds embodied in the recording to be heard in public, the right to be paid equitable remuneration of an amount —
(i)
agreed between the copyright owner and X; or
(ii)
in default of agreement, decided by a Copyright Tribunal.
