Specifying members’ rights to use, and waive tariff collection for, own portfolio

of Copyright (Collective Management Organisations) Regulations 2023

The membership policy must —

(a)

specify whether a member may continue to use the member’s portfolio and, if so —

(i)

specify the circumstances where the member may continue to use the member’s portfolio; and

(ii)

provide that any specified use is in addition to any other use permitted under the member’s membership agreement; and

(b)

specify whether the CMO may, with the authority of a member, waive the collection of tariffs for the use of the member’s portfolio and, if so, in what circumstances.
