Clause 1

Short title and commencement

This Act may be cited as the Housing and Development (Amendment) Act, 1971, and shall come into operation on such date as the Minister may, by notification in the Gazette, appoint.

Clause 2

Amendment of section 4

Subsection (2) of section 4 of the Housing and Development Ordinance, 1959, (hereinafter in this Act referred to as the “principal Ordinance”) is hereby deleted and the following substituted therefor: —“(2) All deeds, documents and other instruments requiring the seal of the Board shall be sealed with the seal of the Board in the presence of the Chairman or the Deputy Chairman or a member of the Board and an officer of the Board authorised by the Board in that behalf, who shall sign every such deed, document or other instrument to which such seal is affixed, and such signing shall be sufficient evidence that such seal was duly and properly affixed and that the same is the lawful seal of the Board.”.

Amendment of heading to Part IV

The heading of Part IV of the principal Ordinance is hereby amended by deleting the words “LIVING ACCOMMODATION” appearing therein and substituting therefor the word “BUILDINGS”.

Clause 4

Amendment of section 42

Section 42 of the principal Ordinance is hereby amended by inserting immediately after the word “flat” appearing in the second and in the third lines thereof in each case the expression “, house or other building”.

Amendment of section 43

Section 43 of the principal Ordinance is hereby amended by deleting the words “living accommodation” appearing in subsections (1) and (2) thereof and substituting therefor in each case the word “building”.

Section 44 of the principal Ordinance is hereby amended by inserting immediately after the word “flat” wherever it appears therein in each case the expression “, house or other building”.

Section 45 of the principal Ordinance is hereby amended by deleting the words “living accommodation” wherever they appear in subsections (1) and (3) thereof and substituting therefor in each case the word “building”.

Clause 8

Amendment of section 48

Section 48 of the principal Ordinance is hereby amended —

(a)

by inserting immediately after the word “flat” wherever it appears therein in each case the expression “, house or other building”; and

(b)

by deleting the words “of his residence” appearing in paragraph (e) thereof and substituting therefor the words “allowed in the lease”.

Amendment of section 49

Subsection (1) of section 49 of the principal Ordinance is hereby amended —

(a)

by deleting the words “living accommodation” appearing in paragraph (a) thereof and substituting therefor the word “building”;

(b)

by inserting immediately after the word “flats” appearing in paragraph (c) thereof the expression “, houses or other buildings”;

(c)

by inserting immediately after the word “flat” appearing in paragraph (c) thereof the expression “, house or other building”.(d)by inserting immediately after the word “flat” appearing in paragraph (d) thereof the expression “house or other building”; and

(e)

by inserting immediately after the word “flats” appearing in paragraph (f) thereof the expression “, houses or other buildings”.
