Easement of support

Section 16
(1)
In respect of each lot there is implied —
(a)
in favour of the subsidiary proprietor of the lot, and as appurtenant thereto, an easement for the subjacent and lateral support thereof by the common property and by every lot capable of affording support; and
(b)
as against the subsidiary proprietor of the lot, and to which the lot is subject, an easement for the subjacent and lateral support of the common property and to every other lot capable of enjoying support.
(2)
The easement of support created by this section entitles the subsidiary proprietor of the dominant tenement to enter on the servient tenement to replace, renew or restore any support.
