Regulation 22B

Prescribed information to be obtained by licensee

The following information in relation to a loan is prescribed for the purposes of section 66(1)(d) of the Act:

(a)

if the applicant is an individual —

(i)

whether the applicant —

(A)

is employed or self‑employed;

(B)

is a platform worker within the meaning given by section 5(1) of the Platform Workers Act 2024; or

(C)

is unemployed and is not a platform worker;

(ii)

the total income of the applicant during the 3 months immediately preceding the month in which the application for the loan is made; and

(iii)

whether the applicant is an excluded person;

(b)

if the applicant is not an individual — whether it is a corporation, an unincorporated association, a partnership, a limited liability partnership or other entity;

(c)

in addition to the information required to be obtained under section 66A(2)(a) read with section 66(1) of the Act, the following information relating to any proposed surety for the loan:

(i)

the amount of the loan that the proposed surety is to be liable for under the contract for the loan in the event of default by the borrower;

(ii)

if the proposed surety is not an individual — whether it is a corporation, an unincorporated association, a partnership, a limited liability partnership or other entity.
