Private Investigation and Security Agencies Regulations

Subject to paragraphs (2), (3) and (4), every application for a private investigator’s licence or a security guard agency’s licence shall be made using —

Subject to paragraph (4), in the event of a malfunction or failure of the electronic application service provided by the Government, an application for a private investigator’s licence or a security guard agency’s licence shall be made using the electronic application service provided by the licensing officer.

Subject to paragraph (4), in the event of a malfunction or failure of the electronic application service provided by the licensing officer, an application for a private investigator’s licence or a security guard agency’s licence shall be made using the electronic application service provided by the Government.

In the event of a malfunction or failure of both the electronic application service provided by the Government and the electronic application service provided by the licensing officer, an application for a private investigator’s licence or a security guard agency’s licence shall be made in Form A in the Schedule.

The form prescribed for an application made using the electronic application service provided by the Government shall be the electronic form provided for that electronic application service at https://licences.business.gov.sg/.

The form prescribed for an application made using the electronic application service provided by the licensing officer shall be the electronic form provided for that electronic application service at http://www.spf.gov.sg/licence/.

The fee payable for a private investigator’s licence shall be $400 per year or part thereof.

The fee payable for each copy or a replacement of a private investigator’s licence shall be $10.

The fee payable for a security guard agency’s licence shall be $400 per year or part thereof.

The fee payable for each copy or a replacement of a security guard agency’s licence shall be $10.

A photograph of the size and form suitable for passports of the person to whom an identification paper is to be issued shall be affixed to the identification paper.

The size of the identification paper in Forms E and F set out in the Schedule shall be 10.5 cm by 14.8 cm and these forms shall be printed on white paper in black ink.

A licensee shall submit to the licensing officer an annual return of all persons employed by him to assist him in the work of a private investigator or as a security guard in his business.

The annual return shall be submitted at such time as the licensing officer may direct.

Subject to paragraph (4) —

In the event of a malfunction or failure of the electronic service, the annual return shall be submitted in Form G set out in the Schedule.

A licensee who wishes to employ any person to assist him in the work of a private investigator or as a security guard —

A fee of $16 shall be payable on an application under paragraph (1).

Subject to paragraph (3) —

In the event of a malfunction or failure of the electronic service, an application under paragraph (1) shall be made in Form H set out in the Schedule.

Subject to paragraph (2), when a person employed by a licensee to assist him in the work of a private investigator or as a security guard ceases to be so employed, the licensee shall, within 14 days of the cessation of employment, notify the licensing officer of this fact using the electronic service provided by the licensing officer.

In the event of a malfunction or failure of the electronic service, a notification under paragraph (1) shall be submitted to the licensing officer in such form and manner as the licensing officer may determine.

A licensee shall at all times maintain an up-to-date register of all persons employed by him to assist him in the work of a private investigator or as a security guard.

The register shall contain the following personal particulars of each person employed by the licensee to assist him in the work of a private investigator or as a security guard:

The register may be kept in the form of an electronic record.

Subject to paragraph (2), a licensee shall, within 14 days of any change taking place in any of the particulars that were declared by the licensee in his application for a licence, inform the licensing officer in writing of the change.

Where a licensee who has changed his residential address makes a report within 14 days of the change under section 8 of the National Registration Act (Cap. 201), he shall be deemed to have informed the licensing officer of the change in his residential address in compliance with paragraph (1).

When a licence is granted to a partnership and there is a change in the partnership, the new partnership shall, within 7 days of the change, apply for the licence to be transferred to them and the licensing officer may, in his discretion, permit a transfer of the licence.

A fee of $40 shall be payable on the transfer of the licence.

Subject to paragraph (4), an application under paragraph (1) shall be made using the electronic service provided by the licensing officer.

In the event of a malfunction or failure of the electronic service, an application under paragraph (1) shall be made in such form and manner as the licensing officer may determine.

Subject to paragraph (2), where a licensee is a company, the licensee shall, within 7 days of any change in the particulars of its directors, notify the licensing officer of the change using the electronic service provided by the licensing officer.

In the event of a malfunction or failure of the electronic service, a notification under paragraph (1) shall be submitted to the licensing officer in such form and manner as the licensing officer may determine.

A licensee shall not change his business address or the name under which his business is carried on until he has notified the licensing officer in writing of the intended change and the licensing officer has granted his written approval for such change.

A fee of $20 shall be payable on a change of address or the name under which the business is carried on.

Subject to paragraph (4), a notification under paragraph (1) shall be submitted using the electronic service provided by the licensing officer.

In the event of a malfunction or failure of the electronic service, a notification under paragraph (1) shall be submitted in such form and manner as the licensing officer may determine.

Any licensee of a security guard agency who wishes to provide any security transportation shall notify the licensing officer in writing that he intends to provide such a service.

Where such licensee is transporting any cash exceeding $250,000, or gold, jewellery or other valuables of a value exceeding that amount, he shall ensure that there are at least 2 armed guards from an agency approved by the licensing officer to protect such property while it is being transported.

In this regulation, “security transportation” means the transportation of cash, gold or other valuables by whatever means.

For the purposes of this regulation, a person shall be deemed to be providing security transportation if he furnishes or provides or notifies or states that he is willing to furnish or provide or in any way holds himself out to the public as ready to furnish or provide security guards for the transportation of cash, gold or other valuables for or in consideration of any remuneration.

Any person who contravenes or fails to comply with any of these Regulations shall be guilty of an offence.

Any person guilty of an offence for which no penalty is expressly provided shall be liable on conviction to a fine not exceeding $2,000 or to imprisonment for a term not exceeding 12 months.
