Transitional provision
Subregulation 1
Notwithstanding any provision in these Regulations, any packaging manufactured to a design approved by the Chief Executive under the provisions of the revoked Regulations may continue to be used, subject to the following conditions:
the necessary multilateral approval of the package design is obtained;
a specification of the quality assurance programme is provided to the Chief Executive;
the activity limits and material restrictions of the Second Schedule are complied with;
for a package containing fissile material and transported by air, the requirement of regulation 52(5) is complied with; and
a serial number, according to the provisions of regulation 27(5), is assigned to and marked on the outside of each packaging.
Subregulation 2
Changes in the design of the packaging or in the nature or quantity of the authorised radioactive contents which, as determined by the Chief Executive, would significantly affect safety shall be required to meet these Regulations.
Subregulation 3
All packagings for which manufacture begins after 31st December 2006 shall comply with these Regulations.
