Subregulation 1

A person commits an offence if —

(a)

the person installs, repairs or calibrates any speed warning device in a vehicle mentioned in rule 3(2); and

(b)

at the time the speed warning device is installed, repaired or calibrated (as the case may be), the person is not an authorised person or an appointed contractor who is engaged by an authorised person to carry out the installation, repair or calibration of the speed warning device, as the case may be.

Subregulation 2

A person commits an offence if —

(a)

the person seals any speed warning device; and

(b)

at the time the speed warning device is sealed, the person is not an authorised person.

Subregulation 3

A person who is guilty of an offence under paragraph (1) or (2) shall be liable on conviction —

(a)

in the case of a first offence — to a fine not exceeding $1,000 or to imprisonment for a term not exceeding 3 months or to both; and

(b)

in the case of a second or subsequent offence — to a fine not exceeding $2,000 or to imprisonment for a term not exceeding 6 months or to both.
