Duties of owner
Subregulation 1
The owner of a vehicle installed with an approved speed warning device under these Rules must ensure that —
the approved speed warning device or any cable or wire connected with its operation is not adjusted or tampered with in any manner that prevents the device from operating as specified in rule 4(3);
any seal on the approved speed warning device is not broken;
if the seal is broken — the vehicle is sent to an authorised person or appointed contractor for the device to be checked and resealed; and
the approved speed warning device is accurate and in a proper working condition at all times.
Subregulation 2
A person who contravenes paragraph (1) shall be guilty of an offence and shall be liable on conviction —
in the case of a first offence — to a fine not exceeding $1,000 or to imprisonment for a term not exceeding 3 months or to both; and
in the case of a second or subsequent offence — to a fine not exceeding $2,000 or to imprisonment for a term not exceeding 6 months or to both.
