Regulation 9
Driving with faulty speed warning device, etc.
Subregulation 1
A person commits an offence if the person drives a vehicle installed with a speed warning device under these Rules when the device is faulty or when any of the seals on the device is broken.
Subregulation 2
In a prosecution of a person for an offence under paragraph (1), it is a defence for the person charged to prove, on a balance of probabilities, that the person charged drove the vehicle for the sole purpose of having the vehicle sent to an authorised person or appointed contractor for the speed warning device to be checked, repaired or resealed.
Subregulation 3
A person who is guilty of an offence under paragraph (1) shall be liable on conviction —
in the case of a first offence — to a fine not exceeding $1,000 or to imprisonment for a term not exceeding 3 months or to both; and
in the case of a second or subsequent offence — to a fine not exceeding $2,000 or to imprisonment for a term not exceeding 6 months or to both.
