Regulation 3

Saving and transitional provisions relating to sections 116 and 143 of Road Traffic Act

Subregulation 1

Any written approval granted by the Minister before 1st November 2010 under the former section 116(1) for any competition or trial of speed that is to take place on or after that date shall be deemed to be a permit granted by the Deputy Commissioner of Police under the new section 116(1).

Subregulation 2

Any order made by the Minister before 1st November 2010 under the former section 116(3) regulating or restricting the use of any road or part thereof for the purposes of any competition or trial of speed that is to take place on or after that date shall be deemed to be a police order issued by the Deputy Commissioner of Police under the new section 143(2).

Subregulation 3

Where any application for the written approval of the Minister under the former section 116(1) that has been made before 1st November 2010 is pending on that date, such application shall be deemed to be an application made to the Deputy Commissioner of Police —

(a)

under the new section 116(2) for a permit referred to in the new section 116(1); and

(b)

under the new section 143(3) for a permit referred to in the new section 143(1),and the application shall be dealt with by the Deputy Commissioner of Police accordingly under those new sections.
