Preservation of secrecy

No person may disclose any information which has been obtained by that person in the performance of that person’s duties or the exercise of that person’s functions in relation to the operations of a RACA (including the RACA’s RACASP) or KC (including the KC’s KCSP) (as the case may be) unless the disclosure is —

(a)

required for the purpose of performing that person’s duties or exercising that person’s functions under these Regulations or Part IIB of the Act;

(b)

required by any court;

(c)

required by the NCASA; or

(d)

required under the provisions of any written law.

Subregulation 2

Any person who contravenes paragraph (1) shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $20,000 or to imprisonment for a term not exceeding 30 months or to both.
