Declaration of owner’s consent

Where an application for planning permission, conservation permission, subdivision permission or outline permission under Part III of the Act is made in the form of an electronic record through the relevant electronic service under these Rules and the applicant is not the owner of the land which is the subject of the application, then paragraph (2) shall apply.

Subregulation 2

If the consent of the owner of the land to the application is required to be obtained under the Planning (Development) Rules (R 3) or any other subsidiary legislation made under the Act, the electronic record shall contain a declaration in such form as the competent authority may require that the applicant has obtained the consent of the owner of the land, or of the legal personal representative, if the owner is deceased, to the application.

Subregulation 3

The competent authority may at any time by notice in writing require the applicant to produce evidence of the consent of the owner to the application, and the applicant shall produce such evidence to the competent authority within such period as specified in the notice.
