Evidence
Subregulation 1
The Minister may receive new evidence on any matter relating to an appeal if the Minister is satisfied that ––
(a)
the evidence could not have been obtained with reasonable diligence at the time of the Authority’s appealable decision;
(b)
the evidence, if given, would have had an important influence on the result of the case, though it need not be decisive; and
(c)
the evidence is credible.
Subregulation 2
The Minister may put questions to the parties and the witnesses, whether orally at any hearing in the appeal proceedings or in writing.
