4. Time when information or document deemed to be issued, etc.
Feedback & supportSubject to paragraph (2), any information or document mentioned in section 28A(1) of the Act is deemed to be issued, given or sent to a person by means of the electronic transaction system at the time the information or document is capable of being retrieved by the person through the electronic transaction system.
Paragraph (1) applies only if —
section 28A(1)(b) of the Act has been complied with in relation to that information or document; and
that information or document is uploaded on the electronic transaction system in a manner that enables the information or document to be accessible by the person for subsequent reference.
Subregulation 1
Subject to paragraph (2), any information or document mentioned in section 28A(1) of the Act is deemed to be issued, given or sent to a person by means of the electronic transaction system at the time the information or document is capable of being retrieved by the person through the electronic transaction system.
Subregulation 2
Paragraph (1) applies only if —
section 28A(1)(b) of the Act has been complied with in relation to that information or document; and
that information or document is uploaded on the electronic transaction system in a manner that enables the information or document to be accessible by the person for subsequent reference.
